New Technologies

With a taste for technology

The department naturally advises a large number of companies from the IT sector in the broad sense: telecommunications and electronic communications operators, hosts, on-line traders, solutions suppliers, software and video games industry, IT outsourcing companies, etc. Ulys, almost “naturally”, is THE consultancy firm of the IT sector.

But the firm’s mission does not stop there.

It also assists companies from other sectors of activity which are faced with a problem involving information and communication technology (ICT). Whether this is service providers from the financial and payment sector, SMEs, industrial firms or services companies, the department offers specialist support within the framework of projects or disputes with a technological nature.

Lastly, the department also assists the public sector (including the European authorities) both in the problems it encounters during its public service mission and in its legislative mission.

With a taste for variety

The missions entrusted to the department are extremely varied, just like the client profiles.

There is of course the mission for assistance as part of the management of a project. In this framework the firm’s specialists integrate the project team in order to guarantee the project’s legality and its successful outcome on a legal level.

Then there is the mission of negotiation, both in the project management phase and in the (pre) contentious stage. Whether in direct contact with the other stakeholders or in support of the client’s negotiators, the department participates in the negotiation strategy and the writing of the texts.

Naturally, the firm also regularly defends clients’ interests before the legal or arbitration authorities, or as part of mediation.

Lastly, several clients entrust the firm with missions for raising awareness in the political decision makers and public authorities, both in France and in Benelux. The Brussels team furthermore particularly deals with contracts with the European competition authorities.

With a taste for business

The department makes it a point of honour to always intervene within the framework of business life. The best legal solution is worthless if it is impracticable.

This notably involves ongoing training, not only in law but also on a technological level.

Several solicitors hold additional qualifications and have experience outside of the bar, notably in economics or IT. They are therefore capable of speaking the same language as the client: the language of business, projects and cases.

With a taste for the world

The department realises over half of its interventions outside of its natural area of activity, constituted of France and Benelux.

As new technology law is generally of European origin, the Ulys specialists are able to help clients over the whole of the EU. If necessary, the firm’s networks make it possible to create specialised pan-European teams in just a few hours.

Beyond the EU, many American, Indian, Asian or Middle Eastern clients entrust Ulys with cases requiring intervention in the EU. On these geographical markets, the firm is regularly present in commercial negotiations and company buyouts.

Lastly, the development of the Mediterranean economic zone is accompanied by a growing number of interventions for North African, Israeli and French-speaking African clients.

Niches in the niche

The department has constructed a European reputation in certain sectors: niches in the niche!

  • This is the case in the sectors of electronic payments, e-money and electronic billing.
  • It is also the case with regard to privacy protection, including cyber monitoring of workers. It is also via this niche that the department frequently works with regard to computerised medical records.
  • IT contracts are naturally an ongoing area of activity, both in negotiation and in disputes.
  • The firm assists many technical brokers when the issue of their liability with regard to the content they carry or host arises (FAI, web 2.0, mobile operators, etc.).
  • The protection of minors on the Internet is another subject of daily interest.
  • Lastly, the department is regularly consulted with regard to national and Community competition law, in the IT sector, including appeals before the authorities.
